The Fujian Provincial Market Regulation Bureau responded to inquiries regarding inaccuracies in the nutritional labeling of prepackaged foods, clarifying whether such errors can be deemed as label defects. According to Article 37 of the “Measures for Supervision and Inspection of Food Production and Operation” (State Administration for Market Regulation Order No. 49), if discrepancies in labeling and instructions are found that fall under the second paragraph of Article 125 of the Food Safety Law, the regulatory authority will order the party to rectify the issue. If the food producer implements corrective measures that ensure food safety, the food and food additives may continue to be sold, provided that corrective actions are clearly communicated to consumers. Determining whether a labeling or instruction defect exists requires considering the relationship between the labeled content and food safety, the intent of the party, and consumers’ understanding of food safety.
